Mellowpan Terms of Use
These Terms of Use (“Terms”) govern your use of Mellowpan, including the iPhone app, Share Extension, widget, Apple Watch companion (where available), and related services (the “Service”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
These Terms are a founder-drafted launch document, not a substitute for personalized legal advice. They are meant to be honest about how Mellowpan works.
1. What Mellowpan is
Mellowpan helps households plan meals, shop, cook, and optionally share food-related posts. The Service may use artificial intelligence to interpret requests and suggest plans, recipes, questions, and related content.
Mellowpan is not:
- a medical device or medical service
- a substitute for a doctor, allergist, or registered dietitian
- a guarantee that any meal is allergen-free, safe, nutritionally complete, or clinically appropriate
2. Eligibility
You must be at least 13 years old to use Mellowpan. If you are under the age of majority where you live, you may use the Service only with a parent or guardian’s permission and supervision. The app is not directed to children under 13 and is not enrolled in Apple’s Kids Category.
3. Accounts and households
You are responsible for your login credentials and for activity under your account.
Household features let multiple people coordinate plans. If you invite others or add managed people (including children or dependents):
- you represent you have appropriate authority to provide their information for shared meal planning
- shared plans, groceries, and inventory may be visible to household members according to household settings
- you should not enter sensitive information about others that you are not allowed to share
4. AI features and permission
Some features send your request and relevant household food context to AI models hosted by Microsoft. Before the first AI-backed use, we show a disclosure and obtain your permission. Details are in the Privacy Policy.
You acknowledge that AI output may be inaccurate, incomplete, inconsistent, or unsuitable. You must review suggestions before cooking or shopping.
We may refuse or limit AI features if permission is withdrawn, if abuse is detected, or if a provider outage occurs.
5. Health, allergy, and nutrition disclaimer
Not medical advice. Meal plans, recipes, filters, food goals, favor/limit preferences, and nutrition-related text are for general informational and household planning purposes only. They are not diagnosis, treatment, cure, prevention, or individualized medical nutrition therapy. Selecting a food goal does not make a meal clinically appropriate.
Allergies and exclusions. We use allergies and exclusions you provide to filter and review suggestions, and we may warn when a recipe appears to conflict. We cannot guarantee that any recipe, catalog item, imported dish, packaged product, or cooking environment is free from an allergen. Ingredients change, labels vary, cross-contact happens, and generative systems can miss things. Always verify ingredients and product labels yourself.
Your responsibility. For medical conditions, severe allergies, or clinician-prescribed diets, consult a qualified clinician and enter the concrete food rules they give you. Do not rely on Mellowpan as your only safety check.
No disease claims. The Service must not be used as a claim that any dish treats, prevents, or controls a disease. If generated text ever implies that, disregard it and report it to support@wytun.com.
6. Subscriptions and payments
Digital features sold in the iOS app use Apple In-App Purchase. Subscription details (name, length, price, trial if any, and renewal terms) are shown on the paywall before purchase and are charged to your Apple Account.
- Subscriptions renew automatically unless canceled in Apple’s subscription settings at least 24 hours before the end of the current period (or as Apple otherwise requires).
- Deleting the app or your Mellowpan account does not by itself cancel Apple billing.
- Restore Purchases is available for eligible Apple purchases.
- Entitlements may also be reflected through RevenueCat.
Refunds are handled under Apple’s policies where applicable.
7. User content and public features
You may create or upload content (recipes, photos, captions, posts). You retain ownership of your content. You grant Wytun a worldwide, non-exclusive license to host, process, display, and distribute that content as needed to operate the Service, including public Discover features when you publish.
You are responsible for having the rights to content you upload or publish. Imported recipes and community posts may require rights attestation before publishing.
If you believe public content infringes your copyright or another right, use the in-app Intellectual property report reason or contact support. We may keep content private while we review a report, and we may ask for limited information needed to identify the work and your authority to act. We do not decide disputed ownership from an email alone; an appeal or formal legal notice may be escalated for qualified advice. Our moderation and retention procedures are described in the Community Guidelines and Privacy Policy.
Before public captions, profile fields, and user photos are published, Mellowpan applies deterministic checks and Microsoft Azure AI Content Safety screening. A high-confidence deterministic prohibition is rejected; uncertain results, higher-severity results, and provider failures remain private and may be reviewed by Wytun's founding operator. This screening is a safety measure, not a guarantee that every objectionable item will be detected.
Public content must follow our Community Guidelines. We may remove content or suspend accounts for violations.
8. Catalog and third-party content
Some recipes or images may come from catalog providers (including TheMealDB) or other sources. Attribution may be shown where required. Third-party content remains subject to its own licenses; we do not promise perpetual availability. Mellowpan's internal source registry can leave a provider unresolved and block it from the public catalog until its current terms and release basis are reviewed.
9. Acceptable use
You agree not to:
- break the law or infringe others’ rights
- upload illegal, hateful, sexual involving minors, violent, or harassing content
- attempt to bypass paywalls, rate limits, or security controls
- scrape the Service at scale or misuse AI features for abuse
- interfere with other users’ households or accounts
- post food content intended to cause severe harm
10. Safety tools
For public content, we provide reporting and blocking tools and founder-operated moderation. Reports can identify a category and include an optional explanation. We aim to acknowledge reports within about 24 hours and act on clearly violative content within about 24–48 hours, as staffing allows. Blocking is enforced server-side across relevant public visibility and interactions for both users; unblocking does not restore likes that were removed when the block was created.
We may dismiss a report, remove content, warn a user, restrict public participation, suspend or ban an account, restore content, or reverse an earlier action. We do not disclose reporter identity, internal evidence, or automated screening scores. If you believe an action was incorrect, email support@wytun.com; the founding operator records and reviews the appeal against the original case.
11. Account deletion
You may delete your account in-app from Settings → Delete account. If you own a household, deleting your account deletes that household and all household-scoped data even when other accepted members remain. Those members keep their accounts but lose the shared household; they can use another household or receive a new empty one. Deleted household data and premium access are not transferred. Public content scoped to the deleted household is removed. Limited records may be retained as described in the Privacy Policy (billing, security, moderation). Cancel Apple subscriptions separately.
12. Intellectual property
Mellowpan software, branding, and design are owned by Wytun LLC or its licensors. You may not copy, reverse engineer, or resell the Service except as allowed by law.
13. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT AI OUTPUT, RECIPES, OR FILTERS ARE ACCURATE, SAFE, OR ERROR-FREE.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WYTUN LLC AND ITS OPERATORS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL. WE ARE NOT LIABLE FOR ALLERGIC REACTIONS, FOODBORNE ILLNESS, COOKING INJURIES, OR DECISIONS MADE BASED ON AI OR USER CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50, EXCEPT WHERE PROHIBITED.
Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent allowed.
15. Indemnity
You agree to indemnify and hold harmless Wytun LLC from claims arising out of your content, your misuse of the Service, your violation of these Terms, or harm resulting from meals you prepare based on the Service—except to the extent caused by our willful misconduct where such limitation is not allowed.
16. Termination
We may suspend or terminate access if you violate these Terms, create risk for others, or if we discontinue the Service. You may stop using the Service at any time and delete your account.
17. Changes
We may update these Terms. We will update the effective date and provide notice for material changes when appropriate. Continued use after changes means you accept the updated Terms.
18. Governing law
These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law rules, except where mandatory consumer protections in your place of residence apply. If Wytun LLC’s formation state differs, we may update this section to match.
